This is a plain-language starting template, not legal advice. Please have it reviewed by a lawyer before relying on it, and fill in your legal operating entity.

SimpleFlare is a transactional email and shared-inbox platform operated by SimpleFlare ("we", "us"). By creating an account or using the service at https://simpleflare.app you agree to these Terms.

1. The service

SimpleFlare lets you send transactional email through an API and receive and reply to email in a shared inbox, across one or more brands. Email delivery is provided through Cloudflare's email infrastructure. We may add, change, or remove features over time.

2. Your account

You are responsible for your account, your API keys, and everything sent or received through it. Keep your credentials secret. Tell us promptly at [email protected] if you suspect unauthorized use. You must be at least 18 and able to enter a contract.

3. Trial and payment

Paid plans start with a 14-day free trial. After the trial, continued use requires a paid subscription billed monthly or yearly in advance. Fees are non-refundable except where required by law or stated in our Billing terms. We may change pricing with at least 30 days' notice; changes do not affect your current billing period.

4. Acceptable use

You must follow our Acceptable Use Policy. In short: transactional email only, no purchased lists, no spam, no unlawful, harmful, or deceptive content. We may suspend or throttle sending that harms deliverability, our infrastructure, or other customers, and we may suspend accounts that breach these Terms.

5. Your content

You keep all rights to the content you send and receive. You grant us the limited rights needed to operate the service (transmit, store, process, back up). We do not sell your content and do not use it to train models.

6. Availability

We work to keep SimpleFlare available but do not guarantee uninterrupted service. The service is provided "as is" to the extent permitted by law. Third-party delivery (including Cloudflare and recipient mail servers) is outside our control.

7. Liability

To the maximum extent permitted by law, our total liability for any claim is limited to the fees you paid in the 3 months before the claim. We are not liable for indirect or consequential loss, lost profits, or lost data.

8. Termination

You can cancel any time from your account. On cancellation your data enters a 30-day read-only grace period during which you can export it (see the Privacy Policy), after which it is deleted. We may terminate for material breach.

9. Changes and contact

We may update these Terms; material changes will be notified by email or in-app. Continued use means acceptance. Questions: [email protected].
